These terms govern your use of decodrivecigars.com and every purchase from DecoDrive Cigars LLC, doing business as Deco Drive Cigars (“we,” “us”). Our Shipping, Return & Cancellation, Age Verification and Privacy policies are part of these terms. By using the site or placing an order, you agree to all of them.

Age.

You must be 21 or older, or older if your local law requires. We verify age and may require ID. Providing false age information violates these terms and may be unlawful.

Products.

Cigars are sold for personal use by adults and may not be resold. Photos are representative; wrapper shade, bands and packaging vary by production run. Rare and allocated releases are limited to stock on hand and may be limited per customer. Cigars are agricultural products; variation in appearance, draw and burn is normal and not a defect.

Orders.

Your order is an offer to buy. We may accept or decline it — including for age-verification failure, suspected fraud, resale, a restricted destination, or a pricing or stock error. An order is accepted when it ships. If we decline or cancel, you receive a full refund.

Prices and payment.

Prices are in U.S. dollars and exclude tax and shipping. We may correct errors and cancel orders placed at an incorrect price. Payment is charged at checkout. By paying you confirm you are authorized to use the payment method.

Taxes.

Sales tax is calculated on your shipping address as shown at checkout. You are responsible for any use tax we do not collect.

Shipping and risk.

See our Shipping Policy. Risk of loss passes to you when UPS delivers to the address you provided.

Returns and cancellations.

See our Return & Cancellation Policy. Tobacco products are final sale except as stated there.

Promotions.

Coupons and promotional offers may exclude allocated releases and oversized items, may not be combined, and may end at any time.

Account.

Keep your login private. You are responsible for activity under your account.

Prohibited use.

Do not buy for anyone under 21, resell products, submit false information, use bots or scrapers, bypass age verification or quantity limits, or use the site unlawfully.

Our content.

The site’s text, photos, logos and design belong to us or our licensors. Cigar brand names belong to their manufacturers. Do not copy or reuse site content without permission.

No warranties.

The site and products are provided “as is.” To the fullest extent the law allows, we disclaim all implied warranties.

Limitation of liability.

To the fullest extent the law allows, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to what you paid for the order in question.

Indemnity.

You agree to cover any claims or costs arising from your breach of these terms or misuse of the site or products.

Governing law.

Florida law applies. Any dispute will be heard exclusively in the state or federal courts in Miami-Dade County, Florida. Claims must be filed within one year of arising.

Changes.

We may update these terms by posting a new version. Continued use means acceptance. The terms in effect when you order govern that order.
